Determination Request, DOB Plan Examination

Code: Determination Request (Formal DOB code decision)

Description: (Determination Request) is a formal request for DOB to decide how a Construction Code or Zoning Resolution provision applies to a specific project. When used to challenge a plan-examination objection, it follows a rejected Second Review of Plan Examination Objections; it is not the first objection-review step.

Practical Meaning: A Determination Request can be filed as a CCD1 for a Construction Code question or a ZRD1 for a zoning question. If the request appeals a plan examiner’s objection, DOB requires the Second Review to be rejected or upheld first; the applicant may otherwise revise the plans.

Where You May See It: You may see this term in DOB NOW: Build under Determinations, on CCD1 or ZRD1 forms, in a borough-office decision, in a plan examiner’s objection record, or in communications from your architect, engineer, or expeditor.

Why It Matters: A determination can provide an official DOB decision about code or zoning rules affecting a project. It involves a separate filing and fee, and it should not be confused with the no-additional-fee Second Review used first to challenge a plan-examination objection.
