Elevator

Code: Elevator inspection and Certificate of Compliance (legal requirement)

Description: An (elevator) is a regulated vertical transportation device that must be inspected, tested, maintained, and, when required, approved by the NYC Department of Buildings (DOB). In NYC DOB records, the word “elevator” may refer to the device itself, elevator safety requirements, inspection and test reports, violations, or an Elevator Certificate of Compliance. An Elevator Certificate of Compliance is the DOB certificate that authorizes an elevator to operate after DOB receives a satisfactory inspection and test report. It is commonly associated with a new elevator installation, and it may also be relevant after certain elevator work, testing, or DOB compliance issues.

Practical Meaning: For NYC property owners, this means an elevator cannot simply be installed and used without DOB approval. A new elevator must pass the required acceptance inspection and testing process, and DOB must issue a Certificate of Compliance before the elevator is placed into service. The owner must also keep up with required ongoing periodic inspections, Category 1 tests, and—where applicable—Category 3 or Category 5 tests. The certificate is not a substitute for future maintenance or inspections. It confirms that DOB authorized operation following satisfactory testing; the owner must continue meeting all later inspection, testing, filing, repair, and correction requirements. This means the elevator must be examined on a regular schedule by the proper inspector. The inspection helps find unsafe parts, broken equipment, or other problems before people get hurt.

Where You May See It: You may see this term in: DOB NOW: Safety filings and elevator records Elevator inspection, test, and acceptance reports Elevator Certificates of Compliance Building management, maintenance, and service-company files DOB notices, audit records, objections, and violations Documents relating to a new elevator, modernization, alteration, or reinstatement of operation

Why It Matters: A Certificate of Compliance is a key legal document because it authorizes elevator operation after the required inspection and test have been completed satisfactorily. Operating an elevator without the required DOB authorization, failing to file required reports, or failing to correct identified defects can lead to enforcement action, violations, penalties, and safety risks. DOB rules generally require periodic inspection reports to be filed within 14 days, while Category 1, 3, and 5 test reports generally have a 21-day filing deadline.
