After Hours Work Permit

An after-hours work permit* allows construction-related work to be done after regular working hours after a careful review by the issuing agency of the need and any community complaints. Some work needs to be done at night or when there is minimal traffic, for example, delivery of huge HVAC equipment at time square or wastewater work in an office building. These things are better done at night with less traffic and fewer people in and around the building.
To legally perform such work, including evening or night renovation, you must obtain an After Hours Variance (AHV) permit from the Department of Buildings. This applies even if you are a homeowner doing work on your own property. Without this permit, after-hours work is not allowed and could lead to violations or fines. Generally, routine renovation is expected to occur within normal hours. After‑hours work is allowed only when DOB approves an AHV for special conditions (for example safety, traffic, access, or similar reasons).
Evening or nighttime renovation work is usually treated as after‑hours construction and, if allowed, will be limited by DOB approval and NYC noise‑control rules.
